Terms of Service

The IPv6rs Service ("Service") provided by IPv6rs Limited Company ("Provider", "we", "us", or "our") is subject to these Terms of Service ("Terms"). By accessing or using the Service, you ("User", "you", or "your") agree to comply with and be bound by these Terms. If you do not agree with these Terms, you may not access or use the Service.

Definitions

• "Services" refers to the IPv6rs services.
• "User Content" means all materials uploaded, posted, or otherwise transmitted by you through the Services.
• "Confidential Information" includes all proprietary or confidential material disclosed between the parties.

Use of Services

You may use our Services only as permitted by law and according to these terms. We may suspend or stop providing our Services if you do not comply with our terms or policies or if we are investigating suspected misconduct.

User Obligations

• Account Security: You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password.
• Legal Compliance:
• You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, impairs, or renders the Service less efficient.
• You will not attempt to gain unauthorized access to our network or user accounts.
• You agree not to engage in any activity that violates any local, state, national, or international law or regulation.
• You agree not to transmit or store any content that is infringing, libelous, defamatory, obscene, fraudulent, or involves theft of trade secrets.
• You agree not to transmit any material that contains viruses or other harmful computer code.
• You agree not to attempt to bypass any measures of the Service designed to prevent or restrict access to the Service, or any portion of the Service.

Payment Terms

• Fees: Fees for using IPv6rs service are billed on a monthly, annual or bi annual basis and are non-refundable, except as required by law or as explicitly set forth in these Terms.
• Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel your service before the end of the current cycle.

Intellectual Property Rights

• Ownership: We retain ownership of all intellectual property rights in our Services. Using our Services does not give you ownership in our Services or the content you access.

Affiliates Program

Eligibility and Enrollment: Upon registering for the IPv6rs Services, users automatically enroll as affiliates ("Affiliates"), eligible to earn commissions for referring new customers to our Services. Participation in the Affiliates Program is contingent upon agreeing to these Terms.

Commission: Affiliates will receive a recurring commission of fifteen percent (15%) for payments made to IPv6rs by new customers they refer, for as long as the referred customer remains active with IPv6rs. Commissions are earned on payments for any service plan.

Payment Terms: Commission payments are issued to Affiliates within sixty (60) days after the end of the calendar month in which the payment from the referred customer was received. Affiliates must provide a valid payment method to receive their commissions compatible with our supported options. A minimum threshold of $50 must be earned before a payout will be made.

Affiliate Obligations:

• Account Security: Affiliates are responsible for maintaining the confidentiality of their account and password and for all activities that occur under their account.
• Legal Compliance: Affiliates must ensure that their referral activities comply with all applicable laws, regulations, and these Terms. This includes not engaging in or promoting illegal or unethical practices.
• No Unauthorized Access: Affiliates are prohibited from attempting to gain unauthorized access to the Service or other user accounts.
• Content Restrictions: Affiliates may not use the Affiliates Program to transmit infringing, libelous, defamatory, obscene, or otherwise objectionable or illegal content.

Termination: IPv6rs reserves the right to terminate an Affiliate's participation in the Affiliates Program at any time for any reason, with or without notice. Upon termination, the Affiliate will forfeit any unpaid commissions.

Relationship of the Parties: Your participation in the Affiliate Program does not create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and IPv6rs.

Indemnification: You agree to indemnify and hold harmless IPv6rs and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your participation in the Affiliate Program.

Jurisdiction and Dispute Resolution The Affiliates Program and these Terms shall be governed by and construed in accordance with the laws of Los Angeles, CA, without giving effect to any principles of conflicts of law. Any dispute arising out of or related to these Terms or the Affiliates Program shall be settled by binding arbitration in Los Angeles, CA, in accordance with the rules of the American Arbitration Association, and the judgment on the arbitration award may be entered into any court having jurisdiction thereof.

Modifications to the Affiliates Program: IPv6rs reserves the right to modify any of the terms and conditions of the Affiliates Program at any time, at its sole discretion. Changes will become effective immediately upon posting on the Service or notifying Affiliates directly. Your continued participation in the Affiliates Program following such changes will constitute your acceptance of the modifications.

General: These Affiliates Program terms are incorporated into and form a part of the Terms of Service. By agreeing to the Terms of Service, you also agree to be bound by the Affiliates Program terms.

Data Protection

• Privacy: Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information.
• Data Security: We will implement reasonable and appropriate security measures to protect your data from unauthorized access, disclosure, alteration, and destruction.

Disclaimers and Limitations of Liability

• Warranties: Our Services are provided "as is," and we make no warranties of any kind, express or implied, including, without limitation, warranties of merchantability or fitness for a particular purpose.
• Liability: To the extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Guarantees

• IPv6rs makes no guarantee about the availability of its service. You understand that it can be unavailable. Additionally, IPv6rs may, from time to time, rotate IP addresses. You understand your IP may change - we will do our best to give notice before it does.

Termination

• IPv6rs reserves the right to terminate your account at any time for any reason or no reason at all.
• IPv6rs reserves the right to modify, update or discontinue the service at any time.

Modifications to the Agreement

• We may modify the Terms at any time. It is your responsibility to review the Terms for changes. You agree to be bound by the revised terms.

Indemnification

• You agree to indemnify and hold IPv6rs harmless from any claims, damages, or expenses arising from your use of the service.

Governing Law and Dispute Resolution

• Governing Law: The Terms shall be governed by the laws of Los Angeles, CA, without regard to its conflict of laws principles.
• Dispute Resolution: Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of American Arbitration Association in Los Angeles.

General Provisions

• Entire Agreement: These Terms constitutes the entire Agreement between you and us regarding our Services.
• Severability: If any provision of these Terms are held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
